These general terms of use (hereinafter referred to as the "GTU") aim to define the rights
and obligations of clients within the framework of the use of services provided by []. They
take effect on the date of their publication on the website.
By accessing the website and using the services offered by the Company, the client
confirms their acceptance of these GTU.
If you do not unconditionally accept these GTU, do not access this website and do not use
these services.

Article 3 – Definitions
Subscription: refers to the monthly fee paid by the User to access the Services offered by the Company.
Commission: refers to the amount in euros paid by the Company to the User, corresponding, depending on the subscription plan, to a percentage of the fictitious profits generated during the Stock Trading Simulation.
Demo Account: refers to the virtual account provided to the User by the Company to participate in the Stock Trading Simulation phase with fictitious funds.
User Account: refers to the personal account opened by an individual (the "User") allowing them, subject to a Subscription and under the conditions defined in these GTU, to access the Services offered by the Company.
General Terms of Use or GTU: refers to this document accessible via the Website, which governs the rights and obligations of Users and the Company in the use of the Website and Services.
Force Majeure: refers to any event beyond the Company's control, including but not limited to: power outages, computer failures, telecommunication blockages, fire or flood, natural disasters, epidemics, pandemics, strikes by its staff or by a subcontractor or supplier, war, terrorist attacks, disturbances, riots, or occupation of the territory by foreign forces, negligence by a third party such as those responsible for electricity or telecommunication services, government, regulatory or legal restrictions, legal or regulatory changes to forms of trade, and any other case beyond the control of either party preventing the normal execution of these GTU by that party. The Company, as well as the User, must notify the other party by any available means of any case of force majeure to which they are subject.
Fictitious Gains: refers to the simulated profits obtained by the User when participating in the Stock Trading Simulation, which may, depending on the subscription plan chosen by the User, entitle them to a commission in euros, paid by the Company based on its revenues.
GDPR: refers to the General Data Protection Regulation (Regulation (EU) 2016/679), which governs the protection of personal data within the European Union. Services: refers to all the services offered by the Company, including but not limited to stock trading simulations based on real market prices, access to demo accounts, and, depending on the subscription plan, the potential possibility to earn commissions in euros on fictitious gains.
Stock Trading Simulation: refers to the fictitious trading activity carried out on demo platforms provided by the Company, without any real investment by either the User, the Company, or third parties.
Site: refers to the website www.zenitfunding.com through which the Company offers its Services.
Company: refers to Altius Group LLC is solely responsible for managing financial transactions, payment processing, and no financial transactions are handled by Zenit Funding. Altius Group LLC maintains compliance with AML and KYC guidelines
Fictitious Transaction: refers to any simulated transaction carried out by the User as part of the Stock Trading Simulation, without the use of real funds.
User: refers to any individual acting as a consumer for non-professional purposes, who accesses the Website and uses the Services offered by the Company.
Article 4 – Modifications
The Company reserves the right, at any time and without prior notice, at its sole discretion,
to modify and update these GTU, as well as access to and content on its Website.
In the event of modifications to these GTU, the User will be informed upon their next login
to the Website via an appropriate notification. The User then expressly and irrevocably
accepts the modifications.
Refusal to accept the new GTU automatically implies the User's decision to close their
Account.
Article 5 – Services
The Website aims to offer stock trading simulation services based on real market prices, which include:
Subscription Plan 1: Subject to subscribing to the Subscription, the User gains access to a Stock Trading Simulation framed by performance objectives, without the possibility of real gains. This phase allows the User to familiarize themselves with the tools and develop their skills.
Subscription Plan 2: Subject to having met the performance objectives determined in Subscription Plan 1, the User may access Subscription Plan 2 of the Services. The User participates in a new Stock Trading Simulation through a Demo Account, also using fictitious funds, but with the possibility [to earn real commissions].
The Services and related pricing, further described in the annex, are provided by the Company.
The Services do not constitute regulated activities: none of the Services involve investments for the User’s own account or on behalf of third parties in securities or financial investments, and do not constitute any regulated activity (such as investment advice or financial intermediation). If the User decides to engage – entirely at their own responsibility – in activities requiring authorizations in regulated sectors, it is their responsibility to take all necessary measures and comply with the applicable laws and regulations.
Article 6 – Registration
6.1. Opening a User Account
Participation in the Services offered on the Website requires the opening of a personal
User Account by completing the registration form provided for this purpose.
The User Account is personal and nominative.
Without a User Account, it is impossible to use the Services.
Opening a User Account on the Website is only permitted for individuals who have legal
capacity and are at least 18 years old. In this regard, the Company reserves the right to
request proof of the User's age and to verify the information provided at any time. A User
Account may be suspended until age verification satisfactory to the Company is provided.
To validly open a User Account, the User must provide the following personal data:
- Last Name;
- First Name;
- Address;
- Nationality;
- Gender;
- Date of birth;
- Country of residence;
- Postal address;
- Email address;
- Phone number.
- A username; and
- A password.

To validate their email address, the User will receive an email during registration

If it appears that the registration conditions are not or are no longer met, or that the
information provided is not or is no longer accurate, sincere, or up-to-date, the Company
reserves the right to refuse the opening of the User Account or to close it.
Each individual is only allowed to have a maximum of one User Account on the Website. If
the Company reasonably suspects or detects that a single individual has direct or indirect
control over multiple accounts, the Company reserves the right to block the various User
Accounts.
The User Account is strictly personal and cannot be transferred to or used by a third party.
6.2. User Account and Password
The User is responsible for all activities on their User Account.
The User must keep confidential the information related to their User Account, particularly
their password.
The User agrees to immediately notify the Company via email in the event of unauthorized
use of their User Account, password, or any other security breach.
6.3. Subscription to the Plan
Access to the Services offered by the Company on the Website is conditioned upon the
payment of a monthly subscription fee set forth in the annex. This subscription is directly
related to the offer of Services provided by the Company and determined based on access
to all phases constituting the Services.
By subscribing to the Subscription, the User agrees to pay this amount monthly in
exchange for access to these Services.
Failure to pay the Subscription by the User will result in the suspension of access to the
Services.
Article 7 - Obligations Relating to the Use of the Website
By using the Services of the Website, the User agrees to:
- use the Website or its Services only for purposes authorized by:
- the GTU; and
- any law, regulation, or generally accepted practice or directive in the User's country of residence.
- not disrupt or interfere with the security, or participate in any form of abuse of the Website, or any of the Services, system resources, accounts, servers, or networks connected to or accessible through the Website or related or linked websites;
- not create or use a false identity on the Website;
- not disseminate false information or illegal announcements;
- not attempt to gain unauthorized access to the Website;
- not use the Website for illegal purposes or in a manner that could harm the reputation of the Company (or third parties);
- not modify or attempt to modify, by any means or instruments, the software or stock prices, particularly to alter the results;
- not infringe upon the intellectual property rights of the Company or third parties;
- not reproduce, without the Company's permission, in any medium, all or part of the content of the Website;
- not use the personal data accessible via the Website to send unsolicited messages to other Users' email boxes ("Spamming"), for any commercial purposes or otherwise unauthorized;
- not download, upload, email, or otherwise transmit any content that is illegal, harmful, threatening, abusive, constitutes harassment, defamatory, vulgar, obscene, pornographic, invasive of another's privacy, hateful, racist, or otherwise objectionable;
- fulfill any potential tax obligations;
- not allow a third party to use their User Account or use the payment methods or the User Account of a third party or another User, even with their consent; and
- respond to any request from the Company regarding their User Account and provide any supporting documents the Company may deem necessary regarding age, banking information, etc.
Furthermore, the User agrees to be solely responsible for the actions and communications undertaken or transmitted through the Website, particularly through their User Account. In case of non-compliance with the provisions of Article 7 of these GTU, the Company reserves the right to take legal action against the User. Such actions may include, but are not limited to, lawsuits aimed at enforcing the terms and conditions set forth and/or a claim for compensation to cover any damages incurred due to this non-compliance. This compensation may cover legal fees, financial losses, and any other harm suffered by the Company.
Article 8 – Guarantees
The User assumes full responsibility for the use of the Website. Except as otherwise
provided and to the maximum extent permitted by law, this Website and all its content are
provided "as is" and "as available," without any warranties of any kind, express or implied.
In particular, the Company does not guarantee that the Website will meet the User's
requirements, will not experience interruptions, will be appropriate, secure, or free from
errors at all times. Furthermore, the Company is not responsible for the investment
choices (real or not) that the User makes outside the Services offered by the Company.
As a consequence of the above, the User acknowledges that the Company, its officers,
employees, agents, or subcontractors cannot be held liable for the Services offered or
information made available to them for any direct or indirect damages or losses the User
may incur, as well as for any immaterial damages such as loss of opportunity, loss of use,
loss or alteration of data, or costs incurred in acquiring of goods or substitute services
resulting from the use or operation of the Website and/or the Services offered or the
data accessible via the Website, even if the Company has been informed of the
possibility of such damages.
The Company shall also not be liable if, for any reason beyond its control, the platform
and/or its Services were to be modified or temporarily rendered unavailable due to
maintenance or updates.
Likewise, the Company reserves the right to interrupt or suspend the Services offered on
the Website at any time and without notice, without having to justify the reason or grounds
for such actions. In this case, the Company’s liability shall not be engaged in any way, and
Users shall not be entitled to any compensation of any nature whatsoever.
The User agrees to indemnify, defend, and hold the Company, its directors, employees,
representatives, and suppliers, as well as any potential third-party partners harmless
against all losses, expenses, claims, and costs, including attorney fees, arising from any
breach by them of these GTU.
Article 9 – Terms of Use of the Services
9.1. Access to the Website
The use of the Services is exclusively done through information technology, i.e., via the
Website. The User accesses the Services of the Website by logging in.
The Website is accessible via any computer hardware, including a computer, mobile
phone, or any other device that allows a connection to the Internet.
To connect to the Website, the User acknowledges and agrees that they must have the
necessary hardware and software, as well as an Internet connection compatible with the
conditions for providing the Services offered by the Website.
The User is responsible, at their own cost, for the telecommunications and computer
equipment suitable for accessing the Website and the Services of the Company. The User
is fully responsible for the proper functioning of all their computer and electronic equipment
as well as their Internet connection.
The User should ensure that their equipment is:
- free of viruses and malfunctions;
- equipped with the latest updates of their operating system;
- equipped with at least one antivirus with the latest update;
- sufficiently secure to prevent the risk of third parties accessing data related to the Services provided to the User.
The User assumes the technical risks in the event of disturbances or interruptions of Services, particularly those related to power outages, interruptions of phone or Internet connections, malfunctions, or overloads of networks or systems. The Company is not responsible for risks related to Internet access and risks related to the transmission of data remotely by Users.

Article 10 – Intellectual Property
The User acknowledges being informed that the Company is the holder or beneficiary of

animations, images, texts, etc., or any other distinctive sign as well as the software
presented on the Website.
The User benefits only from a license for personal, non-exclusive, temporary, revocable,
and non-transferable access and use strictly limited to usage for commercial purposes and
the software and programs of the Website.
Any other use of the Services or the distinctive signs of the Company outside of the
legitimate and authorized connection of the User is strictly prohibited.
The User is prohibited from infringing in any way upon the above intellectual property
rights, and in particular from reproducing, communicating, using, even partially, the
distinctive signs, or using all or part of the content of the Website without the prior consent
of the Company.
Article 11 – Protection of Personal Data and Use of Cookies

Article 12 – Duration
The User benefits from the Services once their registration has been validated by the
Company.
These Terms and Conditions are valid for an indefinite duration, until the termination of the
User Account or longer for the clauses of these Terms and Conditions that, by their nature,
continue after such termination.
Article 13 – Suspension or Closure of the User Account
13.1. Suspension or Closure of the User Account by the Company
The Company reserves the right to suspend, terminate the registration, and close a User Account temporarily or permanently, without notice or compensation, including during a session, in the following cases:
- The User Account has remained inactive for a continuous period of 12 months or more;
- The Company believes that the User has violated one or more provisions of these Terms and Conditions;
- The User has not provided, within the requested timeframe, all necessary supporting documents for the validation of their User Account;
- The documents or information provided to the Company are incomplete or inaccurate;
- The registration conditions are not or are no longer fulfilled;
- In the case of abusive use of the account opening procedure;
- In the event of suspicion or finding by the Company of fraud or illegal activity by the User, or attempted illegal use of the Website and its Services (even with their consent);
- Any act of hacking of the Website and its Services, including infringement of the Company's intellectual property rights;
- Any act or attempt of collusion between Users.
- Report to all competent authorities, including judicial authorities, any illegal or suspected activities of a User;
- Initiate any necessary or useful legal action to terminate the alleged breach by the User and seek compensation for the damages suffered by the Company.
13.2. Closure of the User Account by the User
The User may terminate their User Account at any time by email or by mail.
The closure of the User Account will take effect on the first day of the month following the
receipt of the User's email or mail by the Company.
13.3. Consequences of Termination of the User Account
The termination of the User Account implies that the User:
- Ceases all use of the Website and the Services; and
- Deletes all copies of them from their computer or any other medium.
Article 14 – Miscellaneous
14.1. Right of Withdrawal
The right of withdrawal described in this article applies only to Users acting as Consumers.
The User has a period of fourteen (14) calendar days from the opening of their User
Account to withdraw from the contract without penalties and without stating a reason.
This period runs from the day the contract is concluded, i.e., the day the User accepted
these Terms and Conditions.
During the withdrawal period, the execution of the contract may only commence after the
User's agreement.
If the User exercises their right of withdrawal after the commencement of the execution of
the contract with their agreement, the User can only be held liable for the payment, as
soon as possible, for the Services actually provided by the Company.
If the User exercises their right of withdrawal after the commencement of the execution of
the contract with their agreement, this automatically implies the User's decision to close
their User Account.
14.2. Complaints
For any complaints related to the Services, the User can either go directly to the Website,
under the "Help" tab, or send a separate email to contact@zenitfunding.com.
Complaints must be submitted no later than 7 days after the event that caused the
complaint. Failing this, the complaint will be inadmissible. The User acknowledges,
however, that the Company is not obliged to investigate or respond to a complaint made
by one User against another User.
Any complaint will be processed during business days, within a maximum period of 72
hours. If further investigations by our suppliers are needed, an additional 72-hour period
may be required.
14.3. Assignability of the Contract
The rights and obligations of the User cannot be assigned to a third party without the prior
consent of the Company.
By these Terms and Conditions, the User agrees that the Company is authorized to assign
the Website or all or part of its Services without any further prior authorization from the
User.
14.4. Security
The Company implements security measures to protect the personal information that the
User provides against unauthorized access and use. However, the User acknowledges
and accepts that transmissions over the Internet are never entirely confidential and secure.
The User recognizes that any message or information transmitted on the Website may be

Article 15 – Applicable Law and Jurisdiction Clause

that the User may assert in accordance with Article 6 of Regulation (EC) No. 593/2008 of
the European Parliament and of the Council on the law applicable to contractual
obligations.
In case of controversy or dispute between the User and the Company arising from or
related to the User's use of the Websites, the parties must try to resolve this dispute
promptly and in good faith within 14 days from its notification by either Party. If they are
unable to resolve this dispute within the specified period, the French-speaking courts of
the judicial district of Brussels shall have exclusive jurisdiction for any dispute concerning
the application or interpretation of these Terms and Conditions.

The French version shall prevail in the event of a conflict between the translation and the French version.
The User acknowledges that, notwithstanding any contrary legislative provision, any claim or action against the Company must be made no later than fifteen calendar days after the event giving rise to the claim.
